The list of requirements for surrogacy in Georgia is not extensive. However, it is essential to determine whether you meet the necessary criteria.
Gestational surrogacy is the only legally permitted form of surrogacy in Georgia.
This means that a woman carries and gives birth to a child for someone else, but she has no genetic link to the child. The child is either the biological child of the intended parents, or the egg or sperm is donated by a third party.
Heterosexual Couple
Only heterosexual couples are eligible for surrogacy in Georgia. To access surrogacy services, couples must either be legally married or have been in a committed relationship for at least one year.
For couples who are not officially married, proof of cohabitation is required. This can include various documents, such as a rental agreement or a medical record from a fertility clinic confirming infertility treatment received a year or more ago.
Inability to Carry a Child
In Georgia, there is no strictly defined list of medical conditions that qualify for surrogacy. According to Article 143 of the Law of Georgia on Health Care, surrogacy is permitted when a woman is unable to carry a pregnancy to term for medical reasons. The specific medical indications are determined by a qualified fertility specialist based on the individual circumstances of the intended mother.
